SUBJECT :Revised Rules Governing Requests for Reconsideration of Denied Claims for Deposit Insurance

Pursuant to its authority under Section 9 (Tenth) of Republic Act No. 3591, as amended (PDIC Charter), the Board of Directors of the Philippine Deposit Insurance Corporation (PDIC) by virtue of Resolution No. 2026-02-21 dated 25 February 2026, approved the promulgation of the following revised rules and regulations for the filing of requests for reconsideration of denied claims for deposit insurance.

SECTION I. STATEMENT OF POLICY

The PDIC is mandated to promote and safeguard the interest of the depositing public by providing insurance coverage on all insured deposits and helping develop a sound and stable banking system at all times. To this end, the PDIC shall pay all legitimate deposits held by bona fide depositors and provide a mechanism by which depositors may seek reconsideration from the decision of the PDIC denying a deposit insurance claim.

SECTION II. COVERAGE

This Regulatory Issuance shall apply to deposit insurance claims denied by the PDIC (“Denied Claims”), either wholly or partially.

A Denied Claim refers to a filed claim which is not paid by the PDIC due to any of the following grounds:

  1. Account or transaction does not fall within the definition of deposit under the PDIC Charter
  1. Account or transaction is excluded from deposit insurance coverage;
  1. Account is not an outstanding deposit liability, as of bank closure;
  1. Claimant is not the beneficial owner of the deposit account as defined in the PDIC regulatory issuance on the determination of beneficial ownership;
  1. Claim is filed beyond the prescriptive period in filing claim for deposit insurance; and
  1. Failure by the claimant to submit the required supporting documents within the period prescribed by the PDIC.

SECTION III. REQUEST FOR RECONSIDERATION OF DENIED CLAIMS

A depositor may seek reconsideration of a Denied Claim by filing a request for reconsideration within sixty (60) calendar days from receipt of the notice of denial of the claim on any of the grounds provided under Section II hereof.

A request for reconsideration filed after the lapse of the sixty (60) calendar day period shall no longer be entertained by the PDIC.

All requests for reconsideration shall be:

  1. In writing using the prescribed form (Annex A);

  2. Verified under oath;

  3. Accompanied by the original or certified true copies of the documents which have not been submitted at the time of the filing of claim to support the deposit/s made in the bank or establish the bona fide depositor of the account such as, but not limited to, negotiated checks, copies of validated deposit slips for deposits made in the closed bank or those directly made to its depository bank, official receipts, deposit agreements, bank statement/ statement of accounts, or other documents evidencing receipt of funds by the closed bank other than the evidence of deposits;

  4. With an express waiver of the provisions of Republic Act No. 1405, otherwise known as the Bank Secrecy Law, as amended, Republic Act No. 6426, otherwise known as the Foreign Currency Deposit Act, as amended, Republic Act No. 8791, otherwise known as the General Banking Law of 2000, and express consent to process personal information under Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012; and

  5. With a statement authorizing the PDIC and its officers, employees or agents to examine, inspect or inquire into any or all of bank deposit records in any bank relative to the claim for deposit insurance in order to check the authenticity and veracity of documents submitted and allegations made in support of the request.

SECTION IV. MANNER OF FILING

Requests for reconsideration and its supporting documents shall be filed by:

  1. Submitting personally to the PDIC Public Assistance Center; or

  2. Sending by registered mail; or

  3. Sending by courier service; or

  4. Transmitting by electronic mail to rfr@pdic.gov.ph the PDF copy of the request for reconsideration and supporting documents;

and addressed to:

In case of personal filing, the date of receipt stamped by the PDIC on the request for reconsideration shall be considered as the date of filing.

In case of filing thru registered mail, the date of mailing appearing in the post office stamp on the envelope or the registry receipt shall be considered as the date of filing.

In case of filing thru courier service, the date of sending based on the document tracking number shall be considered as the date of filing.

In case of filing thru electronic mail, the date of electronic transmission shall be considered as the date of filing.

SECTION V. DECISION ON THE REQUEST FOR RECONSIDERATION

The PDIC may either grant, dismiss, or deny the request for reconsideration.

Upon receipt of the request for reconsideration of a Denied Claim, the PDIC shall evaluate if it is sufficient in form and in substance.

If the request for reconsideration is not sufficient in form and substance, the PDIC may:

  1. Dismiss the request for reconsideration on any of the following grounds:

i. For being filed out of time; or

ii. For failure to comply with the prescribed form; or

iii. For failure to submit supporting documents within the period prescribed by the PDIC.

  1. Call for a clarificatory meeting.

If the request for reconsideration is sufficient in form and substance, the same shall be submitted for decision to either grant or deny the RFR based on its merits, and the depositor shall be notified thereof. The PDIC shall have sixty (60) calendar days within which to issue its decision, reckoned from the date of notice to the depositor submitting the RFR for decision.

The notice of decision shall be served to the depositor thru:

  1. Personal service; or

  2. Registered mail; or

  3. Courier service; or

  4. Electronic mail.

The decision on the request for reconsideration shall be deemed final and executory.

SECTION VI. REMEDY IN CASE OF DISMISSAL/DENIAL OF REQUEST FOR RECONSIDERATION

A depositor whose request for reconsideration is dismissed or denied by the PDIC shall have thirty (30) calendar days from receipt of notice dismissing or denying the request for reconsideration within which to file a petition for certiorari with the Court of Appeals pursuant to Sec. 5(g) of the PDIC Charter.

SECTION VII. REPEALING CLAUSE

All issuances, rules and/or regulations of the PDIC which are inconsistent with this Regulatory Issuance are hereby repealed or amended accordingly.

SECTION VIII. EFFECTIVITY

This Regulatory Issuance shall take effect fifteen (15) calendar days after publication in a newspaper of general circulation in the country and the filing thereof with the Office of National Administrative Register of the University of the Philippines Law Center.
